Terms of service
General Terms and Conditions
§ 1 Scope
These General Terms and Conditions apply to all contracts that you as a customer conclude with us, Huber - mein Lebensgefühl Sonnenschutz, owner Simone Huber, Neudeckerstr. 9, 83512 Wasserburg am Inn, via the online shop huber-meinlebensgefuehl.com or via offers on online marketplaces such as kleinanzeigen.de. We do not recognise any deviating terms of the customer unless we have expressly agreed to their validity in writing.
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
§ 2 Conclusion of contract
The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the button “Buy now” or “Order with obligation to pay”, you submit a binding offer to purchase the goods in the shopping cart. Before submitting the order, you can check and correct your entries at any time using the functions provided in the ordering process.
After receipt of your order, you will receive an email confirming receipt (order receipt confirmation). This does not yet constitute acceptance. The purchase contract is concluded when we accept your order by means of a separate order confirmation by email or dispatch the goods, but at the latest upon expiry of five working days after receipt of the order, provided we do not reject the order. In the case of payment in advance or via an online payment service, the contract is concluded upon completion of the payment process.
For offers on online marketplaces, the contract is concluded when we expressly accept your enquiry or your purchase offer by message.
The contract text is stored by us and sent to you by email together with these General Terms and Conditions. The contract language is German.
§ 3 Prices and payment
All prices are in euros including statutory VAT and plus the shipping costs shown during the ordering process. The prices at the time of the order apply.
Payment is made using the payment methods offered during the ordering process. For custom-made products and goods that are only manufactured for you after your order, we may require a down payment or payment in advance; we will point this out before the contract is concluded. In this case, production only begins after receipt of payment.
You only have a right of set-off if your counterclaims have been legally established or recognised by us. You may only exercise a right of retention insofar as your counterclaim is based on the same contractual relationship.
§ 4 Delivery and shipping
We deliver within Germany and Austria. The shipping costs and the shipping method (parcel or freight forwarder) are stated on the respective product page and during the ordering process.
Delivery times are stated on the respective product page. Many items are only manufactured by the manufacturer after the order; the delivery time stated there is the manufacturer's information. In the case of payment in advance, the delivery time begins upon receipt of payment. If, contrary to expectations, an item is not available, we will inform you immediately and refund any payments already made.
Goods shipped by freight forwarder are delivered free to the kerbside. Please check the shipment for externally visible transport damage upon delivery and note this on the freight forwarder's delivery note. Your statutory rights remain unaffected.
For consumers, the risk of accidental loss and accidental deterioration of the goods passes to you upon handover. For entrepreneurs, the risk passes upon handover to the transport company.
§ 5 Right of withdrawal
Consumers have a statutory right of withdrawal. The details are set out in our cancellation policy. There is no right of withdrawal for goods which are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer. This includes in particular parasols, awnings, louvered roofs, roller shutters, external venetian blinds, screens, garden furniture, shade sails and heaters that are made to your specifications in terms of size, colour, covering, control or technical design.
§ 6 Retention of title
The goods remain our property until full payment has been made.
§ 7 Warranty
The statutory rights for defects apply. For entrepreneurs, the warranty period for new goods is one year from delivery. This reduction does not apply to claims for damages due to injury to life, body or health or in cases of intent or gross negligence. Manufacturer guarantees exist in addition to the statutory rights; their scope is set out in the guarantee conditions of the respective manufacturer.
§ 8 Liability
We are liable without limitation for damage resulting from injury to life, body or health, for damage based on intent or gross negligence, and under the German Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely, our liability is limited to the foreseeable damage typical of the contract. Otherwise, liability is excluded.
§ 9 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Wasserburg am Inn.
Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.
